May 18, 1886
In the divorce case of Edward Bush against Mary C. Bush a decree
of divorce was awarded some time ago upon the grounds of desertion set
out by the libellant and without notice having been personally served upon
the respondent. Recently an application was made by the respondent
to have the decree set aside, upon the grounds that the alleged facts upon
which the libellant obtained his divorce were not true, and that no desertion
had taken place. The Court filed an opinion on the 4th instant, vacating
the decree of divorce and restoring the case to its former position, with
leave to the libellant to reply in twenty days.
It seems that the parties were married in Lycoming County, August
17, 1882. Shortly after the marriage the young husband went to his
home at Newberry Station, and the wife, who was several years his senior,
went to her former home, the husband promising to call for her in a few
days. He did not keep this promise, however, some time afterward
she had him arrested for the support of herself and child. In order
to free himself he made various promises, but failed to keep them.
The young man’s father then went to the woman and offered her
a home with himself and his wife, but she refused to live with them, believing
that their feelings toward her were not very friendly. Upon this
refusal a pretext for a divorce was based. It is stated that the
young man’s own admissions show that he had never contributed toward support
of his wife or child, and his efforts to free himself for them have, so
far, resulted as above stated.
