This is a transcription of the "Will of
Benjamin Ashley of Shippen, Tioga County, PA by Ken Chapman

NOTE FROM JMT - Benjamin Ashley was born in Sullivan Township 10 APR 1839,
son of Lavina Orvis & Ethan A. Ashley. His wife was Sarah Jane

Register's Office, January 6, 1909, This day was
presented an instrument of writing purporting to be the Last Will and Testament
of Benjamin Ashley, late of Shippen Township, Tioga County Pennsylvania,
deceased as follows viz:
Know all men by these presents, that I, Benjamin F. Ashley of
Shippen township, Tioga County, Pennsylvania, being in feeble health, but
of sound mind , memory and understanding, do make publish and declare this
my last Will and Testament, hereby revoking and declaring null and void
all and every will by me at any time heretofore made.
Item I. I hereby will and direct that all my just debts and the expenses
of my last sickness and burial be fully paid and satisfied.
Item II. I hereby devise and bequeath to Raymond A. Kennedy, son of
Isaac Kennedy, all the property of every kind or description of which I
shall die seized or possessed, or be entitled to: to have and to hold to
him the said Raymond A. Kennedy, his heirs and assigns forever. Lastly
I hereby nominate, constitute and appoint Isaac Kennedy as guardian of
said Raymond A. Kennedy until he shall have attained the age of twenty
one years: the said Isaac to have charge and control of the property hereby
devised and bequeathed to said Raymond A. during his minority and to manage
invest the same or any proceeds thereof for the benfit of said Raymond.
I also hereby appoint said Isaac Kennedy the Executor of this will. Witness
my hand and seal the 26th day of December 1907.

Signed, sealed, published and declared by B.F.Ashley the testator above
named, as and for his last will and testament in our presence and we in
his presence and in the presence of each other, at his request sign our
names hereto as attesting witnesses, the 26th day of December 1907. D.D.
Stubbs, C.E. Heise.
Commonwelth of Pennsylvania, Tioga County, ss: This day before me Ransford
W. Field, Register for the Probate of Wills and Granting Letters of Administration
in the County of aforesaid, personally carrie C.E. Heise of Delmar Twp.,
P.O. Wellsboro R.F.D. # 3 the subscribing witnesses to the foregoing will.
This being duly sworn according to law, does say that he was peesent and
saw and heard Benjamin F. Ashley the testator sign, seal, publish, pronounce
and declare the foregoing instrument of writing as and for his last will
and testament and that at the time of so doing he was of sound mind, memory
and understanding to the best of his knowledge and belief. That said depoient
signed his name as witness thereto at the request of the testator in his
presence and in the presence of D.D. Stubbs.
Sworn and Subscribed before me, this 27th day of March 1908. [Official

Commonwelth of Pennsylvania, Tioga County, ss: This day before me Ransford
W. Field, Register for the Probate of Wills and Granting Letters of Administration
in and for the County aforesaid personally came D.D. Stubbs of Delmar Twp.,
P.O. Wellsboro Pa. R.F.D. No. 3 one of the subscribing witnesses to the
foregoing will, who being duly sworn according to law, does say that he
was present and saw and heard Benjamin F. Ashley the testator sign, seal,
publish, pronounce and declare the foregoing instrument of writing as and
for his last will and testament and that at the time of so doing he was
of sound mind, memory and understanding, to the best of his knowledge and
belief. That said depoiet (sp) signed his name as witness thereto at the
request of the testator in his presence and in the presence of C.E. Heise.
Sworn and Subscribed before me this 6th day of Jany, 1909, [Official

And now January 6, 1909, This foregoing Will is adjudged to be duly
proved as required by law and is therefore admitted to probate and entered
of record and is decreed to be a valid Will and of force and effect as

Same day affidaivit filed showing that decedent died at the house of
I. M. Kennedy, on or about Thursday, March 12, 1908, at 3:15 P.M.
