Registers office, January 13, 1934, This day was
presented the petition of Stephen C. Kennedy of Wellsboro, Tioga County,
Pennsylvania representing: That he was the Executor named in the last Will
and Testament of Mary A. Kennedy, late of Wellsboro, Tioga County, Pennsylvania,
who departed this life at her daughters residence in the City of Williamsport,
Pennsylvania, on the 22nd day of December A. D. 1933, at or about 11:00
P. M.
That said decedent had not married and no children had been born to
said decedent since the excution of said will.
That the value of the personal property was one thousand dollars.
That the value of the real estate was twelve hundred dollars and consisted
of town property located in Corning, Chemung County, New York.
The petitioner therefore prayed that said Will be proved and that Letters
Testamentary be granted to the petitioner.
Said Will as follows:
I, Mary A. Kennedy, ( Widow ), of the City of Williamsport,
County of Lycoming and State of Pennsylvania, being of sound mind, memory
and understanding, do make and publish this my last Will and Testament,
hereby revoking and making void all former Wills by me at any time heretofore
made.
ITEM I. I direct that all my just debts and funeral
expenses be fully paid as soon as possible after my decease. I give to
my Executor, hereinafter named, full power to sell at public or private
sale any or all of my real estate, at any time as to said Executor may
seem best, with full power to make a deed or deeds of general warranty
for the same, with the samr force and effect as I could sell and convey
the same, if living.
ITEM II. I direct that at the time of the sale of
my real estate, located in Corning, N.Y., my Executor hereinafter named,
shall first pay to my son, Rodney C. Kennedy, the sum of Three Hundred
(300) Dollars from the proceeds of said sale.
ITEM III. I give, devise and bequeath to my daughter,
Mrs. Alice Hebe, my full set of dishes marked with the initial "K".
ITEM IV. I give, devise and bequeath all the balance
of my estate, real, personal or mixed, of whatsoever kind and wheresoever
situate, unto my following children, viz. :
Stephen C. Kennedy, Rodney C. Kennedy, Clarence Kennedy, Warren Kennedy,
and Mrs. Alice Hebe, share and share alike.
In the event of death of any of my above mentioned children having
left issue to survive it, then in such event I direct that the issue of
such deceased child or children shall receive the share its deceased parent
would have received, if living.
I do hereby make, constitute and appoint my son, Stephen C. Kennedy,
to be the Executor of this my last Will and Testament.
In Witness Whereof, I Mary A. Kennedy, the Testatrix above named, have
hereunto subscribed my name and affixed my seal, the eleventh day of November
in the year of our Lord one thousand nine hundred thirty-three. ( 1933
).

Signed, sealed, published and declared by the above named testatrix,
Mary A. Kennedy as for her last Will and Testament, in the presence of
us, who have hereunto subscribed our names at her request thereto in presence
of the said testatrix and of each other.

Commonwealth of Pennsylvania, Tioga County, as: This day before me Ernest
H. Green Register for the Probate of Wills and Granting Letters of Adminstration
in and for the County aforesaid, personally came R. D. Clokey and Sarah
S. Clokey the subscribing witness to the foregoing will, and who being
duly sworn according to law, do say that they were present and saw and
heard Mary A. Kennedy the testatrix sign, seal, publish, pronounce and
declare the foregoing instrument of writing as and for her last will and
testament and that at the time of so doing she was of sound mind, memory
and understanding to the best of their knowledge and belief. That said
deponents signed their names as witnesses thereto to the the request of
the testatrix in her presence and the presence of each other.
SWORN AND SUBSCRIBED before me, this 12th day of January, 1934. } R.D.

And now January 12th, 1934. The foregoing Will is
adjusted to be duly proved as required by law and is therefore admitted
to probate and entered of record and is decreed to be a valid Will and
of force and effect as such.

Same day Letters Testamentary on the the foregoing Will were granted
to Stephen C. Kennedy, the Executor named therein; he first having been
duly sworn as required by law.
February 2, 1934. Filled general inventory amounting to $ 902.10.
February 5th, 1934. Filled appraisements for Transfer inheritance Tax
showing gross assets amounting to $ 902.10.
August 2nd, 1938. The first and final account of the Executor examined,
passed and filed.
