This Indenture made this 27th day of March in
the year of our Lord one thousand eight hundred and thirty Between Thomas
Mitchell and Elizabeth his wife of the town and County of Tioga and State
of Pennsylvania of the one part and Richard Mitchell of the town county
and State aforesaid of the other part Witnesseth that the |
said Thomas Mitchell of the first part for and in consideration of the
sum of one hundred dollars lawful money of the United States unto the said
Thomas Mitchell in hand paid or secured to be paid by the said Richard
Mitchell at or before the Sealing and delivery hereof the receipt whereof
is hereby acknowledged HAVE granted bargained sold released and
confirmed and by these present Does grant bargain sell release and confirm
unto the said Richard Mitchell and to his heirs and assigns forever all
that certain lot tract or parcel of land Situate lying and being in the
township and county of Tioga and State of Pennsylvania bounded as follows
On the north by Robert Mitchell on the east by Joseph Martin on the south
by Samuel Westbrook and on the west by Tioga river patented to Samuel Westbrook
by the commonwealth of Pennsylvania and by said Westbrook deeded to Richard
Mitchell containing twenty six acres be the same more or less – Together
with all and singular the houses out houses, buildings, barns, stables
ways and waters water courses rights liberties, privileges, hereditaments
and appurtenances whatsoever thereunto belonging or in any wise appertaining
and the revisions and remainders thereof and all the estate right title
interest use possession, property claim and demand whatsoever of him the
said Thomas Mitchell and his heirs respecting of in and to the same To
have and to hold the said parcel of land hereditaments and premises hereby
granted or mentioned to be granted with the appurtenances unto the said
Richard Mitchell his heirs and assigns to the only proper use and behoof
of him the said Richard Mitchell his heirs and assigns forever. And the
said Thomas Mitchell for himself and his heirs doth covenant promise and
grant to and with the said Richard Mitchell his heirs and assigns by these
presents that he the said Thomas Mitchell and his heirs the said described
parcel of land hereditaments and premises hereby granted or mentioned to
be granted with the appurtenances unto the said Richard Mitchell his heirs
and assigns against him the said Thomas Mitchell and his heirs and against
all other person and persons whomsoever lawfully claiming or to claim by
from or under him them or either of them or any other person whatsoever
shall and will warrant and forever defend by these presents. In Witness
whereof the said parties to these presents have interchangeably set their
hands and seals dated the day and year first above written. Thomas Mitchell
(Seal) Elizabeth Mitchell (Seal) Sealed and delivered in the presence of
Benajah H. Ives, P.R. Adams – Received The day of the date of the above
Indenture of the above named Richard Mitchell the consideration money in
full. Thomas Mitchell – Tioga County (Seal) Be it remembered that on the
thirtieth day of March Anno Domini one thousand eight hundred and thirty
before me the subscriber one of the Justices of the peace in and for the
county aforesaid.
Note from JW: I believe there was a small part of this document on the
next page which was not copied. This would have been the statement of Thomas
Mitchell’s wife, Elizabeth, that she had been examined apart from her husband
and declared that she had signed the document of her own free will and
without compulsion from her husband.
