“In the name of God Amen I John Barns of Plattsburgh in the County of Clinton and State of New York being weak in body ofperfect strength of mind and memory blessed be Almighty God for the same do hereby make and publish this my last will and testament in manner and form following (vis). First I give and bequeath to my eldest and well beloved son John Barns four dollars to be paid to him out of my personal or real estate Also I give to my second and well beloved son Ezra Barns four dollars to be paid out of my personal or real estate Also I give to my third and well beloved son Lemue—Barns four dollars to be paid out of my personal or real estate Also ? give to my fourth and well beloved son Churchill Barns my young three year old red cow Also I give to my two youngest and well beloved sons Churchill Barns and Ezekiel Barns my farm I now live on being fifty acres also my house stock and farming tools to be divided equally between them Also the above named Churchill and Ezekiel for their legacy being more than my other children are to maintain me while I live and to perform the duties incumbent on children to their parents in sickness and in health also to pay Pay all my just and lawf debts Also I give to my son Churchill and Ezekiel all my household furniture to be divided equally between except my crockery ware Also Churchill and Ezekiel are to pay four doll each to my three oldest sons above mentioned Also I give to my well beloved daughters Lydia Coon an- Peggy Rich all my crockery ware to be divided equally between them Also I appoint and will that Kinner Newcumb Elisha Bradford and Royal Spaulding should be my administrators after my deceace to divide and adjust my estate as above mentioned and thereby make nul and void al- my other wills made before this date Sined seald and executed this fifth d—of January in the year of our Lord one thousand eight hundred and seven. “Clinton County js: Be it remembered that on the twenty sixth day of ---- October in the year of our Lord one thousand eight hundred and seven before me Thomas Treadwell Surrogate of the said County personally appeared Royal Spaulding of Plattsburgh of the said County farmer and being dully sworn on his oath declared that he did see John Barns sign and seal the within written instrument purporting to be the will of the said John Barns bearing date the fifth day of January in the year of our Lord one thousand eight hundred and seven and heard him publish and declare the same as and for his last will and testament that at the time thereof he said John Barns was of sound disposing mind and memory to the best of the knowledge and belief of him the deponent and that his name subscribed to the said will is of his own proper hand writing which he subscribed as a witness to the said will in the testators presence and that he saw Elisha Bradford and Royal Spaulding junior the other witnesses to the said will subscribe their names as witnese- thereto in the testaters presence--------

“ The People of the State of New York by The Grace of God- free and independent to all to whom these presents shall come or may concern Send Greeting Know Ye that at Clinton County on the twenty sixth day of October instant before Thomas Tredwe—Esquire Surrogat of our said County the last will and testament of John Barns late of Plattsburg in the said County deceased (a copy whereof is hereunto annesced) was proven and is now approved and allowed of by us and the said deceased having --
Whilst he lived and to the time of his death, goods chattels or credits within this state by means whereof the proving and registering the said will Will and the granting of administration of all and singular the said goods chattels and credits and also the auditing allowing and final discharging the account thereof doth belong to us the administration all and singular the goods chattels and credits of the said deceased and any way concerning his will is granted unto Kinner Newcomb and Royal Spaulding two of the executers in the said will named they being first duly sworn, well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required. In Testimony whereof we have caused the seal of office of our said county at Plattsburgh the thirty first day of October in the year of our Lord one thousand eight hundred and seven
