This day was presented an instrument of writing purporting to be the Last Will and Testament of Mary Cummings, late of Rutland, Tioga County, Pennsylvania, deceased, as follows, viz-
State of Penna, County of Tioga, SS: Will
In the name of God amen I Mary Cummings of Rutland PA, county of Tioga, being in good health of body and of sound and disposing mind and memory do make and declare thus to be my will and testament in manner following that is to say I order that all my just debts funeral expenses and charges of proving this my Will be in the first place fully paid and satisfied and to be paid out of my personal property as far as it goes and after payment thereof and every part thereof I give and Begueath unto my Legal Sons and Daughters as follows I Bequeath unto my sons John Cummings $!.00. I Bequeath unto F.E. Cummings $1.00. I Bequeath unto Silas Cummings J.R. $1.00. I Bequeath unto George Cummings $1.00. I Bequeath unto Polly Cummings $1.00. I Bequeath unto William Cummings $1.00. I also Bequeath unto my son Phil Cummings one half of my real estate my Death and I also Bequeath unto my Grand Daughter Maud White the other half of all my Real estate at my death and if thare be eney thing left after paying my Legal Debts out of the Personal property then the same to be divided euqlly Betweene my Legal Sons and Daughters or their heirs at Law and I Do Hereby nominate, constitute and appoint Abner S. Layton of the Township of Rutland county of Tioga and State of Pennsylvania Executor of this my last Will hereby revoking and making void all former and other Wills by me at any time. heretofore made and Declare this to be my Last Will and testament. In Witness Whereof I the said testator have to this my last Will and testament set my hand and seal the 17th Day of March A.D. 1897.
