Deed to Elias Ball of Litchfield 11 May 1850

This Indenture made the 11 day of May in the year of our Lord one thousand eight hundred and fifty between Martha Ball & Samuel Ball Jr. administrators of all and Singular the goods and Chattels rights & Credits which were of Samuel Ball Sr. late of Litchfield Township deceased. At the time of his death (who died intestate of the first part) and Elias Ball of Litchfield Township of the other part. Whereas the said Samuel Ball in his life time and at the time of his death was Seized in his demure as of fee? And in a certain tract of Land situate in Litchfield Township containing about twenty five acres and whereas administrators of all and singular the goods & chattels receipts & credits which were of the said Samuel Ball at the time of his death, after the death of the said Samuel Ball was in the form of Law committed to the aforesaid Martha Ball & Samuel Ball Jr. and whereas by the petition of the said Martha Ball & Samuel Ball Jr. to the said ? ? ? Setting forth that the personal Estate of Samuel Ball was not sufficient to pay his debts a schedule of which together with an Inventory of said debts and also a statement of all the Real Estate of Said Samuel Ball was thereto attached. And praying said court to allow him to make sale of so much of the said Land as the said court should judge necessary for the proposes aforesaid and thereupon it was considered & ordered by Said Court that the above mentioned twenty five acres of Land bounded on all sides by lands of Samuel Davidson and being the homestead of Samuel Ball deceased be sold on the twenty third day of January A.D. one thousand eight hundred and fifty at 2 oclock P.M. according to the prayer of the said petitioner as by the Records and proceedings of the said court, reference document being had. May fully and at large appear and whereas in pursuance of the said order and by for and virtue of the laws of this State in such case made & provided afterwards to wit, on the said 23rd day of January one thousand eight hundred and fifty at 2: Oclock P.M. the said Martha Ball & Samuel Ball Jr. met at the house on the premises Expose to sale at public Venue the herein after described twenty five acres of land being the above said twenty five acres and bounded on all sides by lands of Samuel Davidson, after duly advertising the land according to law and then & there did sell the same to the said Elias Ball for the sum of Six hundred & forty Dollars he being the highest bidder and that the highest and best price bided for the same which sole our report thereof made to the said Judge on the 9th day of May one thousand eight hundred and fifty was confirmed by the said court & it was considered and adjudged by the said court that the same should be & remain firm & Stable forever as by the records & proceedings of the said court. Reference being diereunto? Had more fully & at large appears now this Indenture, whateth that the said Martha Ball & Samuel Ball Jr. for and in consideration of the said sum of Six Hundred & forty Dollars to them in hand paid by the said Elias Ball at and before the ensealing and Delivery hereof the receipt whereof he doth hereby acknowledge and thereof acquit and forever discharge the said Elias Ball all deat? Piece or parcel of land situate in the Township of Litchfield bounded on all sides by lands of Samuel Davidson and containing twenty five acres together with all and singular the houses, out houses buildings any and also all the estate, right, title interest, property claim and demand whatsoever of the said Samuel Ball Sr. in his lifetime at and immediately before the time of his decease or of them the said Martha Ball & Samuel Ball Jr. in Law or Equity or otherwise - - - -? Of in to or out of the same to Have and to Hold the said piece or parcel of Land hereditatments and premises hereby granted or mentioned so to be with the appurtenances and the said Elias Ball his heirs and assigns to the only proper use and behoof of the said Elias Ball his heirs and assigns forever.

Personally appeared before me Dannie Doane one of the Justice of the Peace in & for said County, Samuel Ball Jr. of Bowntown?, County of Lycoming administrator of the estate of Samuel Ball Sr. deceased late of the township of Litchfield & County of Bradford and acknowledge the above Indenture to be act & Deed and that he executed the foregoing Instrument and the same may be recorded as since witness my hand the 17 day of May 1850 Dannie Doane J.P.

Personally came before me the subscriber one of the Justices of the peace in & for said County above named Martha Ball administratix of Samuel Ball Sr. late of Litchfield deceased and acknowledged the within to be her free act and deed and desire that the same might be recorded as such? Witness my hand & seal this 28 day of May A.D. 1850 Sam’l Davidson J.P.
