This Indenture, Made this twenty seventh day of May one thousand eight
hundred and Sixty three BETWEEN Joseph Reed Ingersoll and John Craig Miller,
Trustees of three fifths of the Estate which was formerly of William Bingham,
the elder, deceased, and Charles Willing, Trustee of the two other fifths
thereof, of the first part, and Welch Ashley of the other part; Witnesseth:
That the parties of the first part, in consideration of Three hundred and
seventeen dollars and sixty one Cents previously paid the receipt of which
is hereby acknowledged Have granted, sold, aliened, enfeoffed, released
and confirmed, and do hereby grant, bargain, sell, alien, enfeoff, release
and confirm to the said party of the second part, his heirs and assigns,
the following described tract or parcel of Land, BEGINNING at the North
West corner of lot No 121. of the allotment of the Bingham Lands in Rutland
Township Tioga County Pennsylvania conveyed to Bennett Reynolds thence
along lines of said lot South ninety perches and one tenth of a perch and
East fifty perches thence along the West line of lot No 119. South three
fourths of a degree West one hundred and forty three perches and six tenths
of a perch thence along lines of lot No 1. Sullivan conveyed to James McConnell
North eighty nine degrees and one eighth of a degree West sixty two perches
and two tenths of a perch and South two degrees and one eighth of a degree
West forty perches thence along the North line of lot No 2. Sullivan West
thirty eight perches and five tenths of a perch thence along the East line
of lot No 118. Sullivan & Rutland North one degree East ninety one
perches and five tenths of a perch thence along the East line of lot No
112. Rutland North one fourth of a degree East one hundred and eighty perches
and eight tenths of a perch thence along the South line of lot No 138.
Rutland conveyed to James Argetsinger East fifty perches and seven tenths
of a perch to the place of beginning Containing one hundred and twenty
two acres and one tenth of an acre with the usual allowance of six percent
for Roads &c be the same more or less. It being lot No 55. of the allotment
of the Bingham Lands in Rutland & Sullivan Townships Tioga County Pennsylvania
and part of warrants numbered 1819. & 1820.
Which said tract of Land was, by Agreement dated the Seventeenth day of
December A. D. 1846 contracted to be sold by the then Trustees of the Estate
of William Bingham the elder deceased to John Smith where equitable title
and interest therein the said party of the second part claims to be vested
in him in his own right To have and to hold the same to the said
party of the second part, his heirs and assigns, to the only proper use
and behoof of the said party of the second part, his heirs and assigns
forever. And the said parties of the first part, for themselves, as Trustees,
and such other persons as may hereafter be appointed Trustees of the said
Estates respectively, but not for themselves individually, do covenant,
promise and agree to and with the said party of the second part, his heirs
and assigns, that the tract of land hereby conveyed, they, as Trustees,
against all and every person or persons whomsoever (except the said John
Smith and all other persons having title or claim under the before mentioned
Articles of Agreement; and except, also, any person or persons whose title
or interest in said land is or shall be acquired by reason of, or through,
any act or default of the said John Smith his heirs or assigns,) lawfully
claiming or to claim the same, shall and will warrant and forever defend.

On the Twenty Eighth day of May one thousand eight hundred and Sixty
three personally appeared William S. Phillips one of the subscribing witnesses
to the foregoing Indenture, who being duly sworn according to law, did
declare and say, that he was personally present and did see Joseph Reed
Ingersoll, John Craig Miller, and Charles Willing, above named, sign, seal,
and as their act and deed, and the act and deed of each and every of them,
deliver the same; and that the names thereto subscribed as witnesses, are
of the proper handwriting of this deponent and of John M. Houston who also
subscribed his name as a witness thereto in the presence of the said deponent

Jonathan Nichols &c to Charles Keys
To all people to whom these presents shall come. Greeting That we Jonathan
Nichols, Anna Nichols, Samuel Nichols, Jonathan Nichols Junr & Naasson
Nichols all of the township of Tioga in the County of Tioga & State
of Pennsylvania yeoman, for and in consideration of five dollars to me
in hand paid to my full satisfaction the receipt whereof I do hereby acknowledge
& am fully satisfied & contented we have given, granted, bargained,
aliened, released, conveyed & confirmed & by these presents do
freely, clearly & absolutely give, grant, bargain, aliene, release,
convey & confirm unto Charles Keys of the Township of Columbia in the
County of Bradford & State of Pennsylvania his heirs & assigns
forever A certain piece or parcel of Land situated in the Easterly part
of Sheffield on Bush Hill so called in the County of Berkshire in the State
of Massachusetts, buted & bounded as follows, North on Aaron Stevens,
West on Gad Austin, South on James Nichols, East partly on the highway
and partly on Palmer Lovejoy, the piece of Land containing between four
& five acres it is a piece of Land deeded by Joseph Huggins to Anna
Nichols & her heirs
To have & to hold the before granted premises with the appurtenances
& privelidges thereunto belonging to him the said Charles Keyes his
heirs & assigns forever. And we the said Jonathan, Anna, Samuel, Jonathan
Junr. & Naasson Nichols ourselves heirs Executors administrators do
covenant promise & grant unto and with the said Jonathan, Anna, Samuel,
Jonathan Junr. & Naasson Nichols their heirs & assigns forever,
that before & until the ensealing thereof we are the true sole, proper
and lawful owners & possessors of the before granted premises with
the appurtenances & have in us good right, full power & lawful
authority to give, grant, bargain, sell, aliene, release, convey &
confirm the same as aforesaid & that free & clear & freely
& clearly executed acquited & discharged of and from all former
& other gifts, grants, bargains, sales leases, mortgages, & intails,
jointuxes, dowries, thirds, executions, & incumberances whatsoever.
And furthermore we the said Jonathan, Anna, Samuel, Jonathan Junr. &
Naasson Nichols, for our selves our heirs executors & administrators
do hereby covenant promise & engage therefore granted premises with
the appurtenances unto him the said Charles Keyes & his heirs forever
to warrant secure & defend against the lawful claims or demands of
any person or persons whatsoever. ??? whereof we have hereunto set our
hands & seals this twenty first day of August in the year of our Lord
one thousand eight hundred & fifteen
