Probate document and Last Will and Testament of Sackett Hill, deceased. (Van Etten, Chemung County, New York)

Be it Remembered , That heretofore, to wit: on the ninth of January in the year of our Lord on thousand eight hundred and seventy two, Elizabeth Hill, the sole executrix named in the Last Will and Testament of Sackett Hill, late of the town of Van Etten in the county of Chemung, deceased, appeared in open court, before the Surrogate of the County of Chemung and made application to have said Last Will and Testament which relates to both real and personal estate, proved: and on such application the said Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin of the said testator, and their respective residences. Viz: Elizabeth Hill (widow), John Hill (son),

Andrew Hill (son), and Eliza Fredenburg (daughter) all residing in the town of Van Etten, Chemung County and State of New York, and John Hill ** (son) residing in the County of Newaygo, State of Michigan.

And said Surrogate did thereupon issue a Citation in due form of law, directed to the widow heirs at law and next of kin by their respective name, stating their respective places of residence, requiring them to appear before said Surrogate, his office in the city of Elmira in said County on the 12th day of Feby A.D. 1872 to attend the probate of said Will.

And afterwards, to wit: on the 12th day of Feby A.D. 1872 satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said Citation in the mode prescribed by law, and that day no one appearing to oppose the Probate of such Will, such proceedings were thereupon had in said Court, afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 12th day of Feby A.D. 1872 and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament, and proofs, are as follows, that is to say:

In the name of God, I, Sackett Hill ,of the town of Van Etten, the county of Chemung and State of New York, of the age of seventy one years and being of sound mind and memory, do make publish and declare this my last will and testament in manner following, that is to say: First I give and bequeath to my wife Elizabeth twenty-five acres of land that is to be hers her lifetime, then it is to be my sons John Hill or his heirs. Also twenty acres of land that joins Josiah Meeks, and that is to belong to my wife Elizabeth her life time. And lastly I give and bequeath all the rest residue and remainder of my personal estate, goods, and chattels of what nature or kind so ever to my said wife Elizabeth ,whom I hereby appoint my sole executrix of this my last will and testament, hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal this 4th day of May, in the year of our Lord, one thousand eight hundred and seventy one.

Myron Van Etten witnesses his mark: Sackett X Hill (G.S.)

The above instrument consisting of one half sheet was at the date thereof signed, sealed, published, and declared by the said Sackett Hill, as and for his last will and testament, in presence of each other have subscribed our names as witnesses thereto on the above instrument consisting of one sheet, was at the date thereof declared to us by Sackett Hill, the testator therein mentioned, to be his last will and testament, and he at the same time acknowledges to us and each of us that he had signed and sealed the same, and we thereupon at his request and in his presence and in the presence of each other signed our names thereto as attesting witnesses.

** Researcher note by Susan A. Perry:

The reference to " John Hill (son) residing in the County of Newaygo, State of Michigan." is in error. It was Sackett’s son, Thomas Hill, that moved to Michigan and settled in Newaygo County. Sackett’s son, John, resided in New York his entire lifetime. Obviously, Sackett did not have two sons named John; son John was mentioned earlier in the same paragraph "John Hill (son), Andrew Hill (son), and Eliza Fredenburg (daughter) all residing in the town of Van Etten, Chemung County and State of New York " .
