The last Will and testament of David Short

of Deerfield Township in Tioga County and State of Pennsylvania.

I David Short Considering the uncertainty of this mortal life and being of Sound mind and memory (blessed be Almighty God for the Same) do make and publish this my Last Will and tesament in manner and form following Viz. I give and bequeath unto my beloved wife Sally all my household furniture of Whatsoever name or nature. I Will and bequeath unto the heirs of my eldest Son David Short deceased the Sum of Twenty five dollars. I Will and bequeath unto my Daughter Sally Currin the Sum of fifteen dollars. I will and bequeath unto my son Reuben Short the Sum of seventy five dollars- I Will and bequeath unto my grandaughter Larany and Larany heirs of my daughter Jane each a good new dress- I further Will bequeath and devise unto my beloved wife Sally Short and my Son Caleb Short all that messuage or tenement or farm on which I reside situate lying and being in Deerfield Towhship and county aforesaid- together with all my free hold estate whatsoever to hold to them the Said Sally Short and the Said Caleb meaning that after the death of my wife Sally Short and my Son Caleb Short my free hold estate shall pass into the hands of the heirs of my said Son Caleb Short if he shall have heirs- Except a Strip or piece of land on each Side of the Several roads or Highways passing through the said farm ten Rods in width which I will and bequeath Solely and only to my wife Sally Short and my Son Caleb Short to be by them Sold and conveyed if they shall think proper or if need require in Village lots but in case my son Caleb Short Shall die without heirs then it is my Will and Meaning that my said Real Estate Should (Except always the said Strip or piece of Land on each Side of the Said Several roads or highways, ten perches wide) be equally divided among my other heirs-

I further will and bequeath unto my Son Caleb Short all my horses cattle and farming utensils of whatsoever name or nature and all my personal property except my house hold furniture on condition that he pay my honest debts, and the several legacies of this Will to the Several Legatees aforesaid. And I hereby appoint my beloved Wife Sally Short to be executrix and my Son Caleb Short and Allen Fraser Jr. to be executors of this my last Will and testament hereby revoking all former Will by me made-

Tioga County ss December 20th 1842 Before me Luman Wilson Register for the probate of Will & granting letters of administration in and for the County of Tioga personally came Eldridge Rathbone & Allen Fraser two of the Subscribing Witnesses to the within Will & being Sworn according to law, did depose and Say that they were present & saw and heard David Short the testator Sign Seal publish pronounce and delcare the within instrument of writing as and for his testament and last Will and at the time of So doing he was of perfect and Sound mind memory and understanding to the best our knowledge observation & belief- Eldridge Rathbone Allen Fraser

And now to wit- March 11th 1843 Letters testamentary were this day issued to Sally Short and Caleb Short. Executors named in the foregoing will, on the estate of David Short deceased. Allen Fraser Jr having declined his right as executor to administer upon the said estate- The said Sally Short & Caleb Short having taken the oath prescribed by law- Inventory Filed March 31st 1843

This is a transcription of the 1836  "Will and Testament of Smith Cornell" of Chatham  Township, Tioga County, PA  by Shirley Copp
Smith Cornell's Will taken from his hand written Will that is on file at the Tioga Co. Courthouse.
     I, Smith Cornell of the Town of Chatham, County of Tioga and State of Pennsylvania, do make and ordain this my last will and testament in the manner and form following. Viz.  I give and bequeath to my dear wife forty acres and a half of land being a half of the eighty one acres lot.   Also the possession of the buildings and an equal share of the lot whereon they stand being a thirty acre lot, also I give to my wife, one bay mare named Pell and two sheep and two hogs & two cows, also one bed and beding and other household furniture and appertinances belong in there too.  I give and bequeath to my son, Nathan, forty acres and a half of land being a half of the eighty one acre lot afore said and also an equal share of the possession of the thirty acre lot.  Also one cow, two hogs, two sheep, also one bed and beding.  I also give to my wife, Rebecca, two two year old heffers.  They being given to discharge a debt of twenty five dollars, money of her own estate.  I also give to my son Hamilton one hundred dollars to be in hand, paid when he is one and twenty years old to be paid by Rebecca Cornell and Nathan Cornell equally.  I give and bequeath to my son, Smith one hundred dollars to be paid by Rebecca Cornell and Nathan Cornell equally.   I give to my son Socrates one new saddle, his share in the estate having been paid heretofore.  All debts against this estate must be equally paid by Nathan Cornell and Rebecca Cornell.    Henry Humphrey, Nathan Cornell and Rebecca Cornell,  I nominate, constitute and appoint sale.  Executors of this, my last will and testament hereby revoke all other and former wills by me at any time here to be made.  In witness whereof I have here unto set my hand and seal this the sixth day of June in the year of our Lord one thousand eight hundred and thirty six.   Signed by Smith Cornell

Signed, sealed, published and declared by the said testator, Smith Cornell as and for his last will and testament in the presence of us who have subscribed our names as witnesses thereto in the presence of the testator. Signed by Asa Short, Abel Cloos, Livinia Ann Woster.

June the 8 of 1836, the eighth, one thousand eight hundred and thirty six. Personally appeared before this within named Smith Cornell and acknowledged the within will and testament to be his free act and deed witness my hand and seal the day and year afore said. Signed by Reuben Cloos.
