Will of Ezra RUTTY, Jr.
Last will and testament of Ezra Rutty Dec'd Late of North Towanda, Towanda

I, Ezra Rutty of North Towanda, Towanda township Bradford County Pennsylvania being in a very infirm state of health and scusible too of my liabilities to sudden death at the same time being in my own apprehension of sound mind do judge it best to make and accordingly do hereby make this my last will and testament. First, I give and bequeath to my son David Rutty the land I own on the N-N West side of Sugar Creek in the township aforesaid lying west of the Brick Yard lot so called it being the same land now and for some time past in the occupancy of my said son David. To leave use and occupy for and during the time of his natural life and at his decease the same shall to go to the two youngest boys of the said David, Frederick Rutty and Hiriam Rutty, my beloved grandchildren to hold as tenants in common between them their heirs and assigns forever. Charged nevertheless in the hands of the said David Rutty with the payments of three hundred dollars in equal amounts to Wealthy Strope, Anna Coon and Louis Granger, my beloved Daughters to be paid by the said David Rutty as soon as convenient to him, say one year after my death. Secondly, I give and bequeath to my son Ezra Rutty Junior the rest and remainder of my real estate. To have use and occupy the same during his natural life and at his decease, give the same to his two sons, my beloved grandchildren Jacob Rutty and Jackson Rutty to hold the same as tenants in common to them their heirs and assigns forever. Charged in the hands of my son Ezra with the payment of one hundred dollars to my beloved Daughter Patience Mills and also the sum of five dollars to Betsey Taylor and the like amount to Polly Crowman (?). Said payments to be made within one year after my death. Provided nevertheless that in case my personal property and debts did at the time of my decease (excetel ? what may be due my sons David Rutty and Ezra Rutty Jr. which sum as are hereby cleared and given to their) shall be found inefficient to pay my funeral charges and just debts. I then order and direct my said Executor herein after named to merit that portion of my real estate herein given to Ezra Rutty, Jr. lying on the south side of the creek til the (?) and profits of the same will fully pay and discharge my just debts. Thirdly, I give and bequeath to my said daughters Wealthy, Anna, Louis and Patience the sum of one hundred dollars each and to my daughters Polly and Betsey the sum of five hundred dollars each which payments are herein secured in my bequest. To my sons David and Ezra And Lastly in case these should be anything left arising from the sale of my personal property and the collection of my debts I then give them the same in equal amounts to my son David and Ezra and mitting confidence in my friend James Elliott I hereby nonnciate constitute and appoint him executor to this my last will and testament hereby revoking all other and previous wills in witness whereof I have heretowith set my hand and seal this thirty first day of August AD one thousand eight hundred and fifty four in the presence of.

Letters (testomentary?) upon the estate of Ezra Rutty deceased late of North Towanda township deceased Granted to James Elliott he having first been and sworn to well and truly administer upon said according to law. Given under the license of the official seal of the Register at Towanda the 16th day of June AD 1855. Inventory filed June 25th 1855.
