Registers Office March 17, 1905
This day was presented an instrument of writing purporting to be the
Last Will and Testament of Ruth P. Inscho, late of Tioga, Tioga County,
Pennsylvania deceased as follows. viz:
I, Ruth Inscho, of the Boro of Tioga in the County of Tioga, and State
of Pennsylvania, being of sound mind memory and understanding and being
mindful of the uncertainly of life and the certainty of death, do make
and publish this my last will & testament, hereby revoking & making
void all former wills by me at any time heretofore made. And first I direct
that my body be decently interred in the Evergreen Cemetery in Tioga Township
Pennsylvania according the rules and ceremonies of the Baptist Church and
that my funeral be conducted in a manner corresponding with my estate and
situation in life. And as to such estate as it has pleased God to entrust
me with I dispose of the same as follows to wit
First. I direct that all my just debts and funeral expenses be paid
by my Executor hereinafter named out of the first income that come into
his hands from my estate as soon after my decease as is practicable.
Second. I give and bequeath to my daughter Mrs. Susan K. Snell wife
of Seth J. Snell, R. Louise Rolason wife of T.F. Rolason, Mary E. Stewart
wife of J.W. Stewart and Eva B. Rhodes wife of Charles Rhodes all of my
personal clothing and wearing apparel of every kind to be equally divided
between them, share and share alike and to their heirs and assigns
forever, and if there should be any disagreement among them in the division
thereof, I direct my Executor hereinafter named to make a just fair, equitable
division of the same giving to each equal parts in value according to his
Judgement.
Third. I give and bequeath to my grand daughter Minna Ayers, the child
of my deceased daughter Lovina, the sum of ten dollars to be paid to her
by my Executor out of any monies that shall come into his hands from my
estate. I consider that the said Minna Ayers has received from the estate
of her deceased grandfather and amount equal to the share her mother would
have received from my estate had she now been living.
Fourth. As to the rest and residue of my estate of whatever name nature
or kind I give and bequeath the same in equal parts to my several children
now living to wit Susan K. Snell, R. Louise Rolason, Mary E. Stewart and
Eva B. Rhodes above named & to John L. Inscho, Jesse P Inscho &
William W. Inscho & their heirs and assigns forever, each to share
and share alike in the same and I hereby authorize and empower the
Executor of this my last will to sell and convey my estate real personal
& mixed as soon after my decease as he can for fair price & divide
the same after paying debts funeral expenses & the legacy herein named
to Minna Ayers and the expenses of the administration of the will, among
the said children now living to wit Susan K. Snell, John L. Inscho, Jesse
P. Inscho, William W. Inscho, Louise Rolason Mary E. Stewart & Eva
B. Rhodes, before named and her heirs.
Lastly, I do hereby nominate & appoint my son William W. Inscho
Executor of this my last will & testament. In witness whereof I Ruth
Inscho the Testatrix have to this my last will written on one sheet of
paper set my hand & seal this day of July A.D. One thousand eight hundred
& eighty five.

Signed sealed and declared by the above named Ruth Inscho as & for
her last will & testament in the presence of us who have hereto set
& subscribed our names as witnesses thereto in the presence of the
said Testatrix and in the presence of each other.

I, Ruth Inscho, the testatrix within named, do hereby make and publish
this codicil to my last will and testament, bearing date the – day of July
A. D. 1885 in manner following to wit: I revoke the devise in item fourth
of this my said will so far as it relates to my daughter Susan K. Snell
and I give devise and bequeath to my son William W. Inscho all such share
or part of my residuary estate as under the fourth item of my said will
was to go to and vest in my said daughter Susan K. Snell and her heirs
to be held by him my said son in trust nevertheless for the use of my said
daughter Susan K. Snell during her natural life. The income from such share
to be paid to her annually and said trustee is empowered and required to
use and pay from the principal sum or fund of said trust such amount or
amounts as he shall from time to time deem necessary for the proper support
and maintenance of my said daughter Susan K. Snell. And further should
my said son William trustee aforesaid become at any time satisfied that
the principal could safely be made over in full to my said daughter Susan
without danger of its being controlled by another then herself it is my
will that in such case the whole principal sum shall be so made over to
and vest in my said daughter Susan K. Snell her heirs and assigns forever.
Should my said daughter Susan die before the said principal or share shall
have been made over to and vested in her then her share or part in this
codicil mentioned is to go to and be vested in her heirs under the intestate
laws of this Commonwealth. In witness I have hereunto set my hand and seal
this 15 day of January 1898

for a codicil to her last will and testament in the presence of us who
in her presence and in the presence of each other have at her request subscribed
our names as witnesses therein.

R. Babcock, Register for the Probate of Wills and Granting Letters of Administration
in and for the County aforesaid personally came James H. Olney one of the
subscribing witnesses to the foregoing will, who being duly sworn according
to law, does say that he was present and saw and heard Ruth Inscho the
testatrix sign, seal, publish, pronounce and declare the foregoing instrument
of writing as and for her last will and testament and that at the time
of so doing she was of sound mind, memory and understanding to the best
of his knowledge and belief. That said deponent signed his name as witness
thereto at the request of the testatrix in her presence and in the presence
of Fred B. Smith the other subscribing witness.

L. Babcock, Register for the Probate of Wills and Granting Letters of Administration
in and for the County aforesaid personally came J. H. Putnam and Kate Engler
now Adams the subscribing witnesses to the foregoing codicil to the will
who being duly sworn according to law do say that they were present and
saw and heard Ruth P. Inscho the testatrix sign, seal, publish pronounce
and declare the foregoing instrument of writing as and for her last will
and testament and that at the time of so doing she was of sound mind, memory
and understanding, to the best of their knowledge and belief. That said
deponents signed their names as witnesses thereto at the request
of the testatrix in her presence, and in the presence of each other.

L. Babcock, Register for the Probate of Wills and Granting Letters of Administration
in and for the County aforesaid, personally came Fred. B. Smith one of
the subscribing witnesses to the foregoing will who being duly sworn according
to law does say that he was present and saw and heard Ruth Inscho the testatrix
sign seal publish pronounce and declare the foregoing instrument of writing
as and for her last will and testament and that at the time of so doing
she was of sound mind, memory and understanding to the best of his knowledge
and belief. That said deponent signed his name as witness thereto at the
request of the testatrix in her presence and in the presence of James H.
Olney the other subscribing witness.

And now March 17, 1905 The foregoing Will and Codicil is adjudged to
be duly proved as required by law and is therefore admitted to Probate
and entered of record and is decreed to be a valid will and of force and
effect as such.

Same day Letters Testamentary on the foregoing Will were granted to
William W. Inscho, the Executor named therein, he first having been duly
sworn as required by law and filed an affidavit showing that said decedent
died at her residence on or about Sunday, March 5, 1905 at 1:30 o’clock
A. M.
April 13, 1905, General Inventory filed amounting to $2781.82

In the Matter of the Estate of Ruth P. Inscho late of Tioga in the said
County of Tioga and State of Pennsylvania, deceased.
Commonwealth of Pennsylvania, Tioga County, ss:
Personally appeared before me a Justice of the Peace W H Westbrook and
Paul Kraiss who upon their solemn oaths, do depose and say, that they will
well and truly and without prejudice or partiality, value and appraise
the goods, chattels and credits which were of said Ruth P. Inscho, deceased,
and in all respects perform their duty as Appraiser, to the best of their
skill and judgment.

We, the undersigned Appraisers of the personal estate of Ruth P Inscho late of Tioga Pa deceased, respectfully certify: That after having been duly sworn in due form of law, we made the appraisement of the personal property of said defendant as set forth in the foregoing schedule of items, and amounting in the whole to the sum of Twenty-seven hundred-eighty-one & 82/100 dollars.
