The last Will and Testament of Asa Parshall of the town & County of Chemung State of New York

I Asa Parshall considering the uncertainty of this mortal life & being of sound mind and memory I (blessed be Allmighty God for the same) do Make & publish this my last will and Testament in manner & form following (that is to say) First I give and bequeath unto my beloved wife Susannah Parshall in lieu of dower or right of the same so long as she shall remain my widow (but in case of her marriage then one third as by law of the state she would be Entitled) all my farm yard garden dwelling house & out buildings situate and lying north of public highway excepting west half of my present dwelling allso excepting one half of barn hay shed and corn house & half of yard & Garden. I also give to my wife as above one half of all the farm stock & utensils which I may possess at the time of my decease also all my household goods & furniture except a reasonable outfit beds &c. to my two youngest now unmarried daughters Louisa & Lemira which they are to have at such times as they may require.

Item I give and bequeath to my son Jesse and to his heirs forever one acre of land to be taken out of my farm on the west side of the road (a public highway) 167 rods (sixteen) East & west by ten (10) rods North & South and adjoining Saul Warren lot.

Item I give & bequeath to my Son Asa Parshall & to his heirs forever my now dwelling house out buildings yard & Gardens on the decease of my wife & the use of such portions Thereof after my decease as I have not otherwise herein disposed of to my said wife.

Item I give & bequeath to my two sons Jesse Parshall & Asa Parshall & their heirs forever all that remains of my real estate situate lying & being in Chemung Share & Share alike to their use immediately after my decease & on the decease of my wife all of my real estate except as above disposed of & bequeathed separately to Jesse & Asa Parshall

Item I give & bequeath to my son Asa Parshall all my Smith tools & one three year old Gray horse colt

Item I give and bequeath to my two sons Jesse Parshall and Asa Parshall all the remainder of the farm stock & utensils not otherwise disposed of. I also give & bequeath to my two sons above named Jesse & Asa my stock in the New York & Erie Rail Road Company.

Item I give & bequeath to my sons & daughters and their heirs forever viz Isaac Parshall, Amsi Parshall, Mercy Grinnell, Elizabeth Roberts, Susan Roberts, Benjamin Parshall, Thomas K Parshall, Ransom Parshall, Luther Parshall, Ruth Insco, Louisa Parshall, Lemira Parshall, & Israel Parshall Share & Share alike the land or real estate I shall or may own in the State of Michigan & also Equally to my last above named children all moneys on hand or money due me at the time of my decease.

Item I give & bequeath to my children Mercy Grinnell, Amsi Parshall, Elisabeth Roberts, Thomas K Parshall, Ransom Parshall, Luther Parshall, Susan Roberts, Israel Parshall, Ruth Insco, Louisa Parshall, Lemira Parshall two hundred dollars each deducting then from all such payments as I have or may in my life time make to them as by receipt or charges will appear & the ballance of said Two hundred dollars to be a charge upon my real estate hereby given or intended to be given to my two Sons Jesse & Asa Parshall and to be by their hand in manner & form following to wit Two hundred dollars on the first day of May after they Jesse & Asa Parshall shall come with full possession of said Estate (they having the privilege of paying sooner or at anytime when convenient) and in the following order to Mercy Grinnell & Ruth Insco One hundred dollars each on the first day of May cash above referred to & then after to such of my children as in my life time shall have been paid least and in same order until all shall have been paid.

It is my will that in case either of my sons Jesse or Asa Parshall should die intestate and without lawful issue that the other shall have the full share & interest of the said deceased one of the real & personal estate of which he may die seised by virtue of this my will & he the remaining one to take upon himself the payment of the legacies or ballance of legacies remaining due & unpaid.

It is further my will that before any division of my money on hand or personal estate is made, (as before provided for) all my just debts & funeral expenses shall be paid & I do hereby constitute my beloved wife Susannah Parshall Executrix & my two sons Jesse Parshall & Asa Parshall Executors of this my last will & testament.

In witness whereof I have hereunto set my hand & seal the tenth day of September in the year of our Lord One Thousand Eight hundred & forty Three.

The above Instrument of one sheet was at the date thereof Subscribed by Asa Parshall the testator in the presence of Each of us & was at the same time declared by him to be his last will & Testament & we at his request sign our names hereto as attesting witnesses

Chemung County Asa Parshall Junior being duly sworn says that Asa Parshall father of this deponent late of the town of Chemung in said County deceased died at his place of residence in the town of Chemung & County of Chemung a natural death on the 23d day of March last past that the said Asa Parshall left an instrument in writing purporting to be his last will and Testament which said will disposes of both real & personal property that the said Asa Parshall left the following named children heirs at law & legatees of the said deceased Viz Isaac Parshall Amzi Parshall Mercy Grinell Benjamin Parshall Thomas Parshall Ransom Parshall Luther Parshall Elizabeth Roberts Israel Parshall Susan Roberts Ruth Insco Louisa Parshall Jesse Parshall Lemira Parshall. That Isaac Parshall resides in Hartland Livingston County Michigan Luther Parshall resides in Michigan Israel Parshall resides in same County That Thomas K Parshall resides in same county & Susan Roberts in same county That Benjamin Parshall resides in Tioga County State of Pennsylvania Mercy Grinell & Ruth Insco in Jackson Tioga County, Pa that Amsi Parshall resides in Castile Wyoming County New York & that Ransom Parshall resides in Portage Livingston County N.Y. that the said heirs are of full age & this deponent further saith that Susanah widow as Executrix is named in said will with Jesse Parshall & this deponent as Executors of said will
