Last and Supplementary Will and Testament of Thomas Keeney
Dated April 18, 1840 and April 20, 1840
Tioga County, Pennsylvania
This eighteenth day of April A.D. 1840 before me Luman Wilson Esqr. Register for the probate of Wills and granting letters of administration in and for the County of Tioga personally came Hobart B. Graves and Joseph Aikin the two Subscribing Witnesses to the foregoing will and being duly Sworn according to law did depose and Say that they were present and Saw and heard Thomas Keeney the testator Sign Seal publish pronounce and declare the foregoing instrument of writing as and for his testament and last will and at the time of so doing he was of perfect and Sound mind memory and understanding to the best of our knowledge observation and belief–

Oath to Administer Estate of Thomas Keeney

We Thomas Keeney & Benjamin Bentley do Swear that as executors of the last Will and testament of Thomas Keeney deceased we will well and truly administer the goods and chattels, rights and credits of Said deceased according to law and also will diligently and faithfully regard and well and truly comply with the provisions of the law relating to collateral inheritance, and that as you Shall answer to God at the great day ——

Last Will and Testament of Thomas Keeney
Tioga County, Pennsylvania
September 29, 1838
In the name of God Amen – I Thomas Keeney of Tioga, County of Tioga and State of Pennsylvania being of Sound Mind Memory and understanding through the Mercy of God Do Make and ordain this my last Will and Testament in manner and form following To Wit first and principally I resign my Soul with the Utmost Humility into the hands of Almighty God my Creator hoping for a Blessed immortality through the merits of our Lord and Savior Jesus Christ And my body I desire may be decently intered at the discretion of my Executor – And as for Such Temporal Estate as the Lord in his great goodness and mercy hath intrusted me with I give, divide, and dispose of the Same as follows–I give and bequeath one third part of all my Estate both real and personal wheresoever the same may be situated to my beloved Wife Mercy Keeney during her natural life in Lieu of her Legal dower – I give and bequeath the remaining two thirds of my Real Estate, with the Appurtenances thereunto belonging to each of my Children and one grandchild, herein after named and designated Viz, Mercy Keeney, Ruby Mitchell Mary Bentley, Thomas Keeney Junr, Jesse Keeney, Louisa Stanard, Susannah Parcial, Betsy Patton and John B. Sackett. Which said Real Estate is to be equally divided between my said Children, and grand child John B. Sackett, except the children of the said Mary Bentley who are to have one Equal Ninth part of my said real estate, to be Equally divided between them – And I do further bequeath the One Third part of My Real and personal Estate which is herein bequeathed to my Said Wife Mercy Keeney after her decease to my Children and Grand Child aforesaid in manner aforesaid—
I give and devise to the Heirs of Jesse Keeny my Son Deceased a certain Note which I held against him in his life time, and which I now hold amounting to nearly Eight hundred Dollars in April One Thousand Eight-hundred and thirty six - and by computation at this date, about Nine hundred and forty Dollars and is the only Note I hold against my said Son Jesse Keeney Deceased. And if the amount of Said Note does not amount to as much as one Share to my other children mentioned aforesaid I desire that my Executors make up and pay to the Said heirs of Jesse Keeney out of my personal Estate a sufficient amount to make up the deficiency – I desire, and it is my Will that the residue and remainder of my personal Estate should be Equally divided among my Children and grandchild herein first mentioned, Except the Said heirs of Jesse Keeney Deceased. And I do hereby Appoint my Son Thomas Keeney Junr. and Benjamin Bentley my Executors of this my last Will and Testament hereby revoking all former wills
In witness whereof I the Said Thomas Keeney have hereunto Set my hand and Seal at Tioga this Twenty ninth day of September in the Year of our Lord One Thousand Eight hundred and Thirty eight.

Supplement to Last Will and Testament of Thomas Keeney
Tioga County, Pennsylvania
October 3, 1839
In the name of God Amen. – I Thomas Keeney the Testator above named being still of Sound Mind & good health, do make & ordain this will Supplementary to & Explanatory of my above last will & testament. To wit. Whereas I have made & hereafter may make Sundry advances to one or more of the devisees mentioned in my said will, or their heirs or some of them, now it is my will & intention that such advance with legal interest Shall in all cases be considered & estimated as a part of the Share of such divisee & be deducted from such share on the distribution of my estate, whether such advnce be made to or at the request of such devisee & whether at the time of making such advances the devisee be of full age or a minor or a fem covert or sole, or whether the devisee be in trust or otherwise.
And the Share of My Estate devised to my daughter Louisa Stanard I hereby give & devise to My Son Thomas Keeney in trust for the Sole & Separate use of my said daughter Louisa Stanard & her heirs. Not to be in any wise controlled or used by her husband & I hereby revoke & repeal all Such parts of the above will & such as are inconsistent herewith. Signed Sealed & published & declared by the Testator Thomas Keeney as & for his last will & testament in the presence of us the undersigned who have subscribed our names as witnesses the third day of October AD 1839
