THE LAST WILL & TESTAMENT OF
ELIZABETH BALDWIN
At a Surrogate’s Court, held in and for the county of Chemung, in the State of New York, at the surrogate’s offis in the City of Elmira on the 28th day of July, 1890.
In the matter of Proving the Last Will and Testament of Elizabeth Baldwin, Deceased.
B it Remembered, that heretofore, to-with: On the 20th day of May in
the year of our Lord, one thousand eight hundred and ninety, before the
Surrogate of the County of Chemung, came Will H. Swain named as Legatee
in the Last Will and Testament of Elizabeth Baldwin which relates to personal
property admitted to Probate, and on such application being made, the said
Surrogate duly ascertained who were the heirs at law and next of kin of
the said Testrix and entitled to notice of the time and place of proving
last Will and Testament and found there names, relationship and respective
places of residence to be as follows to-wit:

And thereupon said Surrogate issued a Citation in due form of law, directed to said heirs at law and next of kin, requiring them and each of them to be and appear in said Surrogate’s Court, in the Court House, in the City of Elmira in the County of Chemung, on the 9th day of July 1890 to attend the probate of said Last Will and Testament: that afterwards and on or before the return day of said Citation, due proof was made and produced to said Surrogate of the due service of said Citation, in the manner prescribed by law.
And the matter having been duly adjourned to this day.
That on the 28th day of July, A.D. 1890, no one appearing to oppose the Probate of said Last Will and Testament, said Surrogate proceed in open Courth to take the proofs, of the due execution of said Will, and after taking such proofs, did thereupon adjudge the said Will to be the Last Will and Testament of said Elizabeth Baldwin, deceased, and as such a Will valid, to pass real and personal property, which said Last Will and Testament and proofs are as follows, to-wit:
THE WILL
In the name of God, Amen. I Elizabeth Baldwin of Chemung in the County of Chemung being mindful of my mortality Do this the 6th day of November in the year of our Lord 1888 make and publish this my last will and Testament in the manner following.
First, I give unto George Baldwin my nephew all of my stoves in the house,
Second I give unto Julia Grace my niece Bedrrom set upstairs and also all that is in the room.
Third, I give unto Rosanna Floyd six cane bottom chairs and one cane bottom rocker and on stand.
Fourth I give to Mrs. Albina Swain all of my Parlor Furniture.
Fifth I want Mrs. Albina Swain and Julia Grace to take my clothes and divide them up among my relatives as they think best.
Sixth. I give the carpet in the sitting room to Julia Grace.
Seventh I want my beds and bedding divided between my nieces.
Eighth my Nine dollar table cloth I give to Mrs. William Swain of Waverly.
Ninth I give to Mrs. Owen Swain one large table cloth.
Tenth I give to Mrs Will Swain one dozen napkins.
Eleventh I give to Martha Grace my dining room carpet
12 I give unto Holland Swain’s two married daughters my dishes equally also the oldest daughter of Holland Swain one dozen silver knives and forks. To the youngest daughter of Holland Swain ½ dozen silver teaspoons.
13 I give to Georgia Parshall one silver butter dish
14 I gvie to Mrs. Jennie Culp Silver Cake Basket
15 I give to George Baldwin my Silver Watch
16 I give to Josephine Gere my Gold Watch and Chain
17 I give to Mrs. William Grace my gold spectacles
18 After paying my funeral Expenses &c I give Lester Swain all my money except two hundred dollars which I give to George Baldwin
19 My pictures I want Mrs. Swain and Mrs. Grace to divide with the rest of my things.
20 I give the Bedroom set in the East Room to George Baldwin also everything in the room also six fine towels and six coarse towels also the Hall carpet and all the carpets upstairs
21. I give to my sister Mary my Mother’s picture.
22 I give to Mrs. Benjamin Ross one Table Cloth and fifteen napkins
to match, fringed and embroidered.

The petition of Will H. Swain of the Village of Waverly, County of Tioga, New York, respectfully shows:
That your petitioner is a legatee named in the last will and testament of Elizabeth Baldwin, late of the Town of Chemung in said County of Chemung, deceased.
That the said deceased was at the time of her death, a resident of the County of Chemung, and departed this life on or about the 8th day of November, 1888.
That her last will and testament relates to personal property and purports to have been executed on the 6th day of November, 1888 in the prescence of Ida Carpenter, Maria Beidleman and U.W. Burt subscribing witnesses thereto as your petitioner is informed and verily believes.
