Will and Testament 1353 of Charles Phillips, deceased.
I Charles Phillips of the Township of Springfield County of Bradford and State of Pennsylvania, Being aged and infirm but of sound mind and memory and considering the uncertainty of this mortal life and the certainty of death, do make and publish this as my last will and testament hereby revoking all wills by me heretofore made.
1st. I direct that after my decease that my body decently interned and my funeral expenses be paid and the payments of all my just debts..
2nd. I will that my much beloved Wife Anna Phillips be supported out of my said estate and that for such support she shall have the benefits arising from all my real estate if she shall need so much and I further will that she shall have all my household furniture and goods in fee to be disposed of as she shall deem proper.
3rd. I hereby direct and will that my executor pay out of my said real
and personal estate to my Sons to wit; J. L. Phillips, Charles Phillips
Jr., and Elijah Phillips the sum of three hundred dollars each in the manner
hereinafter to be specified,
Also to my Daughters, Mary Phillips, Louisa Phillips, Sarah Ann Phillips
and Caroline Maynard the sum of two hundred dollars each in manner hereinafter
specified,
Also to my Nephews, Jared King, and Lewis King, the sum of fifty dollars
each when my said Nephews shall arrive at the age of twenty one years.
4th. I hereby will to my Son Martin Phillips all my real and personal
estate subject to the aforesaid legacies said legacies to my said Sons
and Daughters to be paid as follows viz;
fifty dollars each to be paid within one year after the decease of
myself and of my Wife Anna Phillips and fifty dollars apiece each annually
thereafter until the whole of the aforesaid legacies shall be paid, and
it is hereby expressly understood that any and all amounts that my said
Son Martin Phillips has paid or shall pay or care to be paid at the present
time or within, before or after my decease shall be expressly understood
to apply on the said legacies to my said Sons and Daughters and any in
debt direct lien from them or either of them to him shall be deemed and
considered as a payment on said legacies, he having been living with me
with the specific understanding that he might pay on said legacies before
my decease all or any amounts and any receipts whether in due form or not
if intended to pay or apply upon any inheritance or legacy from me to them
to be deemed valid and sufficient.
5th. I hereby appoint my Son Martin Phillips the executor of this my last will and testament and I hereby request and desire that my said Son Martin Phillips after my decease continue to live upon my said real estate and maintain, provide for and take special care of my much beloved Wife Anna Phillips, his mother and do all things necessary for comfort happiness and support during her natural life.
In testimony whereas, I Charles Phillips have hereunto set my hand and
seal at Springfield, Penna., Dec. 22, AD 1859.

We the subscribers witnesses to the foregoing last will and testament
of Charles Phillips do hereby certify that we were present at the making
and signing of the same and hear to the said Charles Phillips declare the
same as his last will and testament and saw him sign the same as such in
our presence and have witness in the same as his last will and testament
at his request and have signed said will as witness in thereto in his presence
and in the presence of each other. As witnesses our hands and seals the
22nd day of Dec. AD 1859.
