Tioga County, Pennsylvania

Dated 11 Sept 1822 – Recorded Book 6 – pg 39-40

This Indenture made the eleventh day of September in the year of our Lord one thousand eight hundred and twenty two Between Uriah Spencer of the Township of Tioga in the County of Tioga and State of Pennsylvania and Elenor his Wife for themselves and for William Martin duly authorised by power of attorney of the one part and John Inscho Farmer of the same Township County and State aforesaid of the other part Witnesseth that the said Uriah Spencer for and in Consideration of the sum of seventy two Dollars fifty cents lawful money of the United States unto the said Uriah Spencer in hand paid or secured to be paid by the said John Inscho by a mortgage on the premises bearing even date herewith at or before the sealing and delivery hereof the receipt whereof is hereby acknowledged Have granted bargained sold released and confirmed and by these presents Do grant bargain sell release and confirm unto the said John Inscho and to his heirs and assigns forever (under nevertheless and subject to the aforesaid mortgage) All that certain piece or parcel of land Situate lying and being in the Township of Tioga in the County of Tioga and State aforesaid Butted Bounded and described as follows (viz) Beginning at an alder the north west Corner of Elisha Booths lot Thence by the line of said lot South fifty degrees East two hundred and thirty four perches and two tenths of a perch to a Post the south east corner thereof Thence south sixty five degrees west eleven perches to a White Pine Tree the south east corner of Richard Mitchels lot Thence by line of said lot North fifty degrees west two hundred and twenty nine perches and six tenths of a perch to a Post the north west corner thereof and Thence North thirty five degrees east ten perches to the place of Beginning fourteen acres and eighty perches of land be the same more or less being that part of warrant No 361 granted by the Commonwealth of Pennsylvania to Joseph Martin who departed this Life leaving two sons James and William to whom the said land descended and the said James also departed this life leaving one undivided moiety in said land to his Brother William who conveyed one third part of the whole to the said Uriah Spencer and the said William Martin by his power of Attorney duly executed on the thirtieth day of September Anno Domini one thousand eight hundred and twenty authorized the said Uriah Spencer to sell and Convey his interest in the said land as a refference thereof being had to the Records of Tioga County in Book No 5 Page 94 will more fully and at large appear. Together with all and singular the houses outhouses buildings barnes stables ways woods waters watercourses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the revertions and remainders thereof and all the estate right title interest use posession property Claim and demand whatsoever of them the said Uriah Spencer and William Martin their heirs respectively of in and to the same To Have and to hold the said of land hereditaments and premises hereby granted or mentioned to be granted with the appurtenances unto the said John Inscho his heirs and assigns to the only proper use and behoof of the said John Inscho his heirs and assigns forever and the said Uriah Spencer and William Martin for themselves their heirs executors administrators and assigns doth covenant promise and grant to and with the said John Inscho his heirs and assigns by these present that theirs the said Uriah Spencer and William Martin and their heirs the said described piece or parcel of land hereditaments and premises hereby granted or mentioned to be granted with the appurtenances unto the said John Inscho his heirs and assigns against them the said Uriah Spencer and William Martin and their heirs and against all other person and persons whatsoever lawfully claiming or to claim under him them or either of them the said premises shall and will warrant and for ever defend by these presents

In Witness whereof the said parties to these presents have interchangeably set their hands and seal dated the day and year first above written Uriah Spencer (Seal) Uriah Spencer Attorney in fact for William Martin (Seal) Eleanor Spencer (Seal) Sealed and delivered in the presence of Elijah DePuy David Lindsey Received the day of the date of the above Indenture of the above named John Inscho seventy two Dollars 50/100 the Consideration money above mentioned in full Uriah Spencer Tioga County ss Be it remembered that on the fourteenth day of October Anno Domini one thousand eight hundred and twenty two before me the subscriber Elijah DePuy Esquire one of the Justices of the Peace in and for said County personally appeared the said above named Uriah Spencer and Elenor his Wife and in due form of law acknowledged the above Indenture to be their free act and deed and also the act and deed of his Constituent William Martin above named by him as his Attorney executed by virtue of the authority contained in the Power of Attorney in said Indenture mentioned and desired the same might be recorded as such She the said Elenor being of full age and first by seperate and apart from her said Husband examined did declare and say that she executed the said Indenture voluntarily of her own free will and accord without any threats coersion or compulsion of her said Husband or any undue influence whatsoever the Contents thereof being by me made known to her Elijah DePuy Justice Peace (Seal)
