THE WILL OF CHRISTIAN KRESS

The People of the State of New York, by the grace of God free and independent. To all whom these presents shall come or may concern send Greeting: Know ye, that at the Town of Chemung in the County of Tioga on the eighth day of May in the year of our Lord One thousand eight hundred and one before Balthazer DHFaert, Esquire, Surrogate of our said County, the last will and testament of Christian Kress deceased (a copy of which is hereunto affixed) was proved and is now approved and allowed of by us, and the said deceased having while he lived and at the time of his death Goods Chattels and Credits within this state, by means thereof the proving and registering the said will and the granting administration of all and singular the said Goods, Chattels and Credits and also the auditing allowing a final discharging the account thereof belonging unto us: the administration of all and singular the goods Chattels and Credits for the said deceased and anyways concerning his wife is granted unto Mary Kress executrix and John Kress executor in the said wife named they being first duly sworn well and faithfully to administer the same, and to make and exhibit a true and perfect Inventory of all and singular the said Goods Chattels and Credits, and also to render a just and true account of administration when hereunto required. In Testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed. In the Name of God, Amen. I Christian Kress of the Town of Chemung in the County of Tioga and the State of New York, being weak in body but of sound mind and memory, do make this my last will and testament: first I give unto my wife Mary Kress the use of one half of my now dwelling house, together with the use of one half of the cellar for and during her natural life and I give unto said wife Mary Kress the full use and improvement of all my lands stock of cattle, and all other articles of every sort and kind that are belonging to my moveable estate for the sole intent and purpose of supporting and maintaining of my said wife Mary Kress, for and during her natural life and that same to be held under the directions, care and order of her my said wife Mary Kress for the intent and purpose as aforesaid and after the decease of my said wife Mary Kress I do order all my lands, and all my moveable estate of every sort and kind to be equally divided between all of my sons and daughters, viz. John Kress, Samuel Kress, Jacob Kress, George Kress and Elijah Kress, Leah Van Gorder, and Sarah Bennet, and to the child or children of my daughter Mary Bishop deceased, their heirs and assigns forever, and I do hereby constitute and appoint my said wife and my son John Kress executors of this my last will and testament. In witness whereof I hereunto set my hand and seal, the twenty fourth day of March in the year of our Lord one thousand eight hundred.

Tioga County Be is remembered that on the tenth day of October in the year of our Lord one thousand Eight hundred personally appeared before me Balthazer DeHaert, surrogate of the county of Tioga, Isaac Beidelman, one of the subscribing witnesses and on the eight day of May in the year of our Lord on thousand eight hundred and one Samuel Beidelman another of the subscribing witnesses to the within instrument of writing purporting to be the last will and testament of Christian Kress late of the town of Chemung in the said County deceased who being duly sworn did sevrally depose and say that they wer present and did see the said Christian Kress sign and seal the said instrument of writing and at the same time heard him publish and pronounce the same to be his last will and testament in the presence also of Abel Fry the other subscribing witness thereto and that they together with the said Abel Fry subscribed their names as witness to thereto in the presence of the testator and of each other and that the said testator at that time appeared to be of sound mind and memory.
